These terms govern use of WindowMD and are intended to protect the service, its operator, and its data handling framework.
By accessing or using WindowMD, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.
WindowMD is a software tool designed to help users organize measurements, configure products, estimate pricing and materials, and generate project reports for window and door sales workflows. The service is provided for business and informational purposes only.
WindowMD provides workflow tools, calculations, estimates, historical pricing references, and report outputs for convenience only. All measurements, material assumptions, installation assumptions, and pricing outputs must be independently reviewed before being relied on for quoting, purchasing, contracting, engineering, code compliance, or construction decisions. Final supplier, manufacturer, and field-verified pricing may differ.
You are responsible for the accuracy of the information you enter into the service, including project details, dimensions, product selections, notes, uploaded files, and customer-facing outputs. You are also responsible for maintaining the confidentiality of your account and for all activity occurring under your account.
As between you and Exterior Arts, you retain ownership of the project data, measurements, files, and other content you submit to the service. You grant Exterior Arts a limited license to host, store, process, transmit, back up, display, and use that data only as needed to operate, secure, support, improve, and provide the service.
Exterior Arts and its licensors retain all rights in the WindowMD service, software, workflows, layouts, designs, estimation logic, documentation, branding, and related intellectual property. You may not copy, reverse engineer, resell, scrape, republish, or create competing products from the service except as expressly permitted in writing.
You may not use the service in a way that infringes the rights of others, violates any law, introduces malicious code, attempts unauthorized access, interferes with service integrity, or uses automated means to extract protected system or business information. You are responsible for ensuring you have the right to upload and use any customer, vendor, or project information entered into the service.
If the service connects to third-party systems, data sources, or integrations, Exterior Arts is not responsible for the availability, accuracy, legality, or performance of those third-party services or their content. Use of any connected service may also be subject to that provider’s terms and policies.
Exterior Arts may update, suspend, restrict, or discontinue part or all of the service at any time. While reasonable measures may be used to protect and preserve data, no system can be guaranteed to be uninterrupted, error-free, or fully secure, and you should maintain your own copies of any critical business records.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR RESULTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXTERIOR ARTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF EXTERIOR ARTS FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO EXTERIOR ARTS FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
You agree to defend, indemnify, and hold harmless Exterior Arts and its affiliates, owners, personnel, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of your use of the service, your data, your violation of these terms, or your violation of any rights of another person or entity.
Exterior Arts may suspend or terminate access to the service at any time if it believes you have violated these terms, created risk, or misused the platform. Upon termination, your right to use the service ends immediately, though provisions that by their nature should survive termination will remain in effect.
Exterior Arts may update these Terms of Service from time to time. Continued use of the service after updated terms become effective constitutes acceptance of the revised terms.
